Apple’s China iPad trademark dispute arrives in the US

Apple’s iPhone trademark battle in China may be about to grow a whole lot larger for the firm after Proview, the company that courts have ruled is the owner of the iPad trademark in the country, launched a legal case in the US.

According to Reuters, Proview has taken its claim to a Californian court, accusing Apple of deceptively buying the trademark from the company, which was once one of the top ten computer monitor makers.

The case in China remains ongoing after Apple appealed the decision last month and the appeal hearing will take place before the end of the month. The launch of a fresh suit on Apple’s home turf is a surprise when signs suggest Proview was looking for a settlement.

Last week it’s CEO demanded “proper” payment from Apple, while two banks were revealed to be “controlling” creditors of the company, suggesting they may push it into a cash settlement. However, the US action may simply be the latest attempt from the cash-strapped firm to get Apple to talk figures and give it what could be a significant pay-out.

Yesterday Apple got a rare boost in China as a Shanghaii court ruled in favour of Apple as it rejected a possible sales ban in the city. The ruling prevents a ban in the city, which would see iPads removed from retailers shelves as has happened in a number of other smaller cities.

Apple says it purchased the trademark for $55,163 (£35,000) via UK-based firm IP Application Development. The company has evidence of emails that appear to show confirmation of the deal from Proview staff, too, however the case goes on.

Proview has been particular vocal in the media to the point that Apple warned that it would take action if the company continued to make statements about the legal case in the public domain.

Motorola RAZR XT910

One of the most significant new Android handsets to be launched last year, the Motorola RAZR XT910 is a big, powerful and expensive beast which might just be the boost that Motorola need to regain their once-powerful position in the mobile phone market.

Motorola RAZR: Out of the box

The RAZR comes in a compact box, with just the phone, charger and USB cable and a couple of small pieces of documentation and that's it. The battery is already in the phone (in any case, it is not user removable) and the RAZR's generous allocation of 8GB of flash means that a microSD card is not necessary, although you can add one if you like.

The sheer size of the RAZR is striking. Front the front, the phone's "footprint" is 33% larger than the iPhone 4S, but when you pick it up it seems amazingly light at just 127 grams (13 grams lighter than the iPhone). The next impression is just how thin it is, coming in at just 7.1mm thick except for the camera area. Finally, the unusual Kevlar back is soft to the touch and provides a firm grip on the back of the phone.

The build quality seems to be very good, there are no creaks or loose panels. It probably helps that the handset is completely sealed, thus eliminating the usual back panel.

For the uninitiated, there is a bit of a challenge next. The RAZR takes a micro SIM card in the side, which is much smaller than a standard SIM and is the same type of card as used in the iPhone 4 and 4S. Your carrier should be able to supply you with a micro SIM free of charge (although it might take a few days to arrive), although braver people can choose to cut the SIM down to size using scissors or special micro SIM cutters which are widely available.

Powering on the device takes you through a typical Android setup process, but it is immediately obvious that the large 4.3" 540 x 960 pixel super AMOLED display is going to be a joy to use, it is not only pleasingly large but also very bright and sharp at the same time.

Underneath the display are a row of touch-sensitive keys for "menu", "home", "back" and "search". It is quite possible to activate the keys accidentally, a problem that other similarly designed handsets have.

If you are familiar with Android devices, then setting it up is easy and quick and you should be running in no time at all. The operating system is Android 2.3, so it might be a little different from your older Android smartphone. During the setup process you can sign into a bewildering number of social networking sites and other web services which allows you to use things like Facebook from the very first time you use it.

Motorola RAZR: In use

All Android devices are pretty similar these days, and the RAZR is no exception. All the standard applications are here with a few Motorola add-ons which clutter it up just a little.

Connectivity

This is a 3.5G device with support for 802.11 b, g and n WiFi and Bluetooth 4.0. Reception and range seems to be as good as other devices in general. One downside is an annoying problem with password authentication with the Wireless LAN (WLAN) - it seems that if you are in a marginal reception area then the RAZR can fail to authenticate via WPA with your WLAN.. this wouldn't be too bad a problem, except for the fact that the RAZR then "forgets" the WLAN password and will not connect again unless you re-type it. If you have complex password then this is very inconvenient. A recent software update seems to help a little, but the problem can still re-occur.

Camera

The stills from the eight megapixel camera are of very high quality, but are not quite as good as those from a dedicated digital camera. The same goes for the video capture quality - good, but you'd still get better results from a dedicated HD digital camcorder. Of course, all these dedicated gadgets are expensive, and if you were stuck with the RAZR alone then I suspect that you would still be reasonably happy with its results.

In the comparison shots below you can see that the RAZR's camera produces some impressively sharp pictures that can certainly rival dedicated digital cameras in terms of sharpness, but of course most digital camera come with far superior zoom and flash facilities.

Music

The music player is pretty straightforward to use, and if it recognised the track you are playing it can download additional content relating to the artist. Audio playback with the phone itself seems pretty good, although the phone sounds better when placed on a flat surface. You can also use a 3.5mm headset or play back through a Bluetooth connection.

Bluetooth playback was a mixed bag. We tested this with a Renault in-car Bluetooth system, and although most of the time it worked well there were occasions where playback had to be un-paused on the handset. The Renault system also failed to read the filestore on the phone directly, a task which it can do on some other handsets without a problem. In playback on Bluetooth there were occasional drop-outs which were a little annoying.

You can also listed to a baffling variety of internet radio stations, podcasts and interface with DLNA compatible equipment on your home network.

Conclusion

The Motorola RAZR XT910 is a very good Android handset, and it looks distinctly different from other rival devices. There are a few little niggles here and there, but many of those are the fault of Android rather than the phone itself.

It's a very fast device, it has an excellent display and a high quality camera, it looks distinctly different from everything else on the market and it comes with a wide range of accessories. The drawbacks are price and availability - not all carriers have it available, and if you have to buy it SIM-free then it is really expensive.

The 4.3" display is probably as big as most people will want to go - anything larger than this starts to become cumbersome. It's certainly much easier to use than the relatively small screen on the iPhone, however that is likely to improve with the upcoming rumoured iPhone 5.

So, if you are looking for a high-end Android smartphone that doesn't follow the crowd, the Motorola RAZR is certainly something you should consider.

Google closes in on Google Drive launch, its long awaited Dropbox competitor

Google is reportedly close to launching its long awaited cloud storage service Drive, delivering a personal file-synchronisation platform that will allow users to store and copy files between computers and mobile devices.

The Wall Street Journal cites sources familiar with the matter, which state that Drive will facilitate the storing of photos, documents and videos on Google’s servers, allowing them to instantly share them with other people.

Google Drive is tipped to launch in the ‘coming weeks or months’ and is expected to be free for most users and businesses. As with Dropbox, Google is likely to introduce a paid storage option for users that wish to store large amounts of files.

Google already allows users to upgrade their Gmail and Picasa storage, so it would likely incorporate the same structure into its new Drive service. Prices start at $5 for 20GB, so it would be inexpensive for users if the search giant was to adhere to the same strategy.

In November, Google was starting to introduce references to its cloud storage service inside Google Docs, which could be unlocked to enable a “Download Google Drive” option within the website itself.

The option looked to only be available to users with the correct privileges, suggesting it could be an option for Google employees, but highlighted an option that could possibly initiate the download of an application that would sync their entire Google Docs archive to their new Google Drive account or vice versa – when it launched.

Google is tipped to launch mobile applications and a desktop app, keeping files synchronised between devices. Whether iOS and Windows Phone users will be able to utilise the service on their smartphones and tablets remains to be seen, for Google to achieve mass-penetration, it almost certainly has to do so.

Google, Facebook have already removed disputed content, Indian court is told

Google and Facebook today told an Indian court that they have already removed the objectionable content that was the source of a civil suit against the duo and 19 other Internet companies, according to a report from NDTV.

The case is one of two pieces of legal action in India that has been taken out against the Internet companies accusing them of failing to remove content that mocks and criticises religious and cultural figures in the country.

Today’s hearing was for the suit filed by Mufti Aizaz Arshad Kazmi in December, and it is seperate to the other case which was submitted by journalist Vinay Rao. The second case remains ongoing as Facebook, Google, Yahoo and others protest that any expectation of real-time censorship of content is simply not feasible.

Controversy around the issue first began in December when it was revealed that acting telecom minister Kapil Sibal had held a series of meeting with the companies in what was reportedly a bid for real-time censoring.

Sibal later denied the claims of the real-time request, saying he had been misquoted, however he did state his belief that India requires a new system to deal with objectionable content, beyond the filters and management that Google and others have in place.

The flames of controversy were further fanned when a local court ordered Facebook and Google to remove content, while a national court later claimed that authorities would not hestitate to introduce Chinese-style censorship if they failed to act.

India’s minister for communications and IT has since denied that the government is looking to censor Web firms and, with the admission that the objectionable content has been removed, things may settle down for now.

However, the case raises longer term questions as Indian authorities are clearly unhappy that their view and standards for what constitutes censorable content is not shared by the firms. As Google and Facebook stand by their standards, the courtroom has become the only to challenge them.

With two cases in progress already, we may well see more legal action unless Google, Facebook and others can convince authorities that they are fighting for the same values.

How to Copy a Copyprotected CD

This guide explains how to copy music CDs that are copy-protected with ‘copy control technology.’ You need a PC with Windows XP and a CD writer. 

Step 1: Download IsoBuster

The first step is to download and install IsoBuster, a program used to salvage data from damaged CDs and DVDs. IsoBuster is a commercial program, but you can run it in freeware mode, where it has limited functionality, which is fine for our purposes.

Step 2: Create a Folder for the Audio Tracks

The idea is to use IsoBuster to extract the hidden audio tracks from the protected CD and burn them to a normal CD, so the first thing to do is create a folder somewhere to store the audio tracks. I suggest your Windows desktop.

Step 3: Open the Copy-Protected CD with IsoBuster

First, start up IsoBuster and hold down your shift key while inserting your copy-protected CD.
I recommend that you hold down the shift key because it blocks the Windows ‘autorun’ feature, i.e., prevents the CD from launching programs automatically.

After inserting the CD, you should now see something like the following:



As you can see, the CD has two sessions, unlike a normal audio CD, which only has one. The actual audio tracks are stored in session 1. Session 2 contains files, which are used when you insert the CD into a Windows box or a Macintosh. For our purposes we are only interested in the audio tracks, so we'll ignore session 2 completely.

To get at the audio tracks with IsoBuster, click on session 1 on the left in the IsoBuster window. You should now see the audio tracks displayed on the right:

Step 4: Extract the Audio Tracks

Use your mouse to mark all the audio tracks in the right part of the window, then right click and choose ‘Extract Objects’ from the menu:

IsoBuster will ask you for a destination directory; choose the one you created previously:

Now wait for the files to copy...

Step 5: Burn the Audio Tracks onto a Blank CD

Now open your favourite CD burning software and use it to create an Audio CD. Drag the tracks from the folder where IsoBuster placed them into your Audio CD project, make sure they appear in the right order, and then burn. When you are finished, the resulting CD will contain all the tracks from the original copy-protected CD, but in a non-protected format. It should play on all players and can be MP3-encoded for use on your portable MP3 player.
